  • What is the Multiple Listing Options for Sellers policy?
    • This policy gives sellers two choices if they do not want their property fully marketed in the MLS right away: Office Exclusive Delayed Marketing Both choices require a signed MLS Exempt Listing Form (Office Exclusive or Delayed Marketing) to ensure sellers understand the tradeoffs of reduced MLS exposure.
  • What is an Office Exclusive listing?
    • An Office Exclusive is not new — it is an existing rule and form already in place. Under this option, the listing is kept completely out of the MLS and cannot be publicly marketed (no signs, flyers, social media, websites, or email blasts). Once submitted on the Office Exclusive Exempt Listing Form, the property cannot be entered into the MLS for at least 90 days. Entering it early may result in a fine of up to $15,000. The seller may petition the MLS Steering Committee for a waiver of the 90-day period, but brokers are responsible for maintaining records showing compliance with this requirement.
  • What is a Delayed Marketing listing?
    • The Delayed Marketing option is a new choice now available to sellers through a newly created form. With this option, the listing is filed with the MLS and shared with all Participants and Subscribers right away, but public marketing (IDX, syndication, portals, etc.) is held back until the seller’s chosen date. During the delay period, the broker may promote the property consistent with the seller’s instructions, but it cannot appear through public MLS feeds until the delay has expired.

  • What is required for Exempt Listing Disclosure?
    • Within one business day, the broker must submit the signed MLS Exempt Listing Form, which includes:
    • Disclosure of the broker’s professional relationship with the seller.
    • Acknowledgement that the seller understands the benefits they are waiving or delaying (such as broad and immediate MLS exposure).
    • Confirmation of the seller’s decision to choose either Office Exclusive or Delayed Marketing.
